1. Seller Identification

These general terms and conditions of sale apply to the sales defined below made by the company THUILLIER PARIS, a simplified joint stock company with a share capital of €10,000, whose registered office is located at 3, rue de Belloy - 75 016 PARIS - FRANCE, registered in the Paris trade and companies register under number 930 735 758. Its SIRET number is 930 735 758 00011 and its intra-community VAT number is FR 12 930 735 758.

2. Scope and acceptance of the General Conditions of Sale

The purchase of products offered on the website www.thuillierparis.com (hereinafter the "Site") and/or by telephone is subject to these general conditions of sale ("General Conditions of Sale").

The Site allows you to order, online via the Internet, from the company THUILLIER PARIS a selection of products of the brand “T. Thuillier Paris” registered with the INPI under number 4420865 (hereinafter the “Product(s)*).

Thuillier Paris Products are exclusively intended to be sold to end consumers, whether individuals or legal entities, to the exclusion of all resellers or intermediaries acting on behalf of resellers. Consequently, the customer declares that he is acting as an end consumer and that he does not intend to resell, directly or indirectly, the Thuillier Paris Products for commercial purposes, this commitment constituting a condition
essential for THUILLIER PARIS.

The customer certifies that he has the legal capacity to enter into the commitments provided for herein.

THUILLIER PARIS may update these General Terms and Conditions of Sale at any time. You can review the version of the General Terms and Conditions of Sale in force at any time by visiting the "General Terms and Conditions of Sale" section of the Site. The sales contract between you and THUILLIER PARIS will include the terms of your order and the general terms and conditions of sale applicable at the time of your purchase, which apply to
the exclusion of all other general conditions or any implied conditions of trade, customer or business practice.

3. Order Terms

For any questions relating to the Products and your orders, you can contact our customer service (hereinafter the "Customer Service") by clicking on the "Contact us" link or by telephone on +33 (0) 6 50 52 09 98, from Monday to Saturday (excluding public holidays), from 10 a.m. to 7 p.m.

The Site allows you to order, online via the internet, from the company THUILLIER PARIS, a selection of Products for collection or delivery under the conditions specified in article 8.1 “Delivery and collection area”.

You can also order by phone by contacting our Customer Service.

These General Terms and Conditions of Sale do not apply to special orders. For any special orders, please contact our Customer Service by email at contact@thuillierparis.com or by telephone at +33 (0) 6 50 52 09 98, from Monday to Saturday (excluding public holidays), from 10 a.m. to 7 p.m.

4. Availability of Products

Product offers are valid within the limit of available stocks. Indeed, at the time of validation of the order, there may be a difference between the stock available electronically and the existing physical stock (for example in the case of simultaneous orders of the same product by several customers). The sale is therefore conditional on the availability of the Products in stock. Furthermore, THUILLIER PARIS reserves ownership of the Products until payment of the Products in accordance with the provisions of Article 7 below.

In the event that a Product is unavailable after you have placed your order, we will inform you by email or telephone as soon as possible, offering you the option of either ordering another Product presented on the Site as a replacement, or cancelling your order.

THUILLIER PARIS shall not be liable in the event of stock shortages or unavailability of Products.

THUILLIER PARIS reserves the right to change at any time and without notice the Products offered on the Site and/or by telephone.

In order to ensure better quality of service and availability of our Products to all of its customers, THUILLIER PARIS reserves the right to limit the quantity of Products that can be purchased by a customer, in accordance with the applicable provisions in this area and in particular those of Article L. 121-11 of the Consumer Code.

5. Order procedure

5.1. Ordering procedure on the Site

5.1.a) Selection of Products

At any time, you can add Products to your selection by clicking on "Add to cart".

5.1.b) Identification

After selecting the Product(s), click on “Order” to start the ordering process.

A customer account is required to be able to place an order on the Site:

  • If you already have a customer account, you will need to identify yourself at this step by entering your password.
  • If you don't have an account yet, you'll be prompted to create one by confirming your email address and creating a password later.

Your identifiers and passwords are strictly personal, therefore you agree to keep them secure and never communicate them to third parties.

In the event of loss, theft or any fraudulent use of your customer account, you agree to inform THUILLIER PARIS immediately.

Creating an account allows you to:

  • track your deliveries and view your order history;
  • return or exchange Products:
  • add or modify your delivery and billing addresses for your future orders;
  • manage your subscriptions to the THUILLIER PARIS newsletter.

Unless proven otherwise by the customer, the data recorded by the Site constitutes proof of the nature, content and date of all transactions between THUILLIER PARIS and its customers. In the event of a dispute between THUILLIER PARIS and one of its customers over a transaction carried out on the Site, the data recorded by THUILLIER PARIS is considered valid proof of the content of the transaction, unless proven otherwise by the customer. You can have your account deactivated at any time by sending an email to Customer Service by clicking on the "Contact us" link.

5.2. Validation of orders placed on the Site

5.2.a) Validation of the delivery method

You will need to validate your delivery method and complete the delivery information required for the correct dispatch of your order: country of dispatch, title, first name, last name, telephone number, delivery address (or the store from which you wish to collect your order, if the selected delivery country has stores offering this service - see Article "8.1 Delivery and collection area") and any other information required to process your order.

5.2.b) Validation of payment of the order

You can use your delivery address as your billing address or enter another one. You will then be prompted to select a payment method (see Article “6. Prices - Accepted Payment Methods”) and enter the related information.

At the end of the ordering process described above and after having accepted all of these General Conditions of Sale and Use and the Site's Privacy Policy, click on the "Pay" button.

You must carefully check the accuracy of your selection before confirming your order. While every effort is made to ensure that the color and pattern of the Products whose photos are displayed on the Site are faithful to the original Products, variations may occur, in particular due to technical limitations of color rendering on your computer equipment. THUILLIER PARIS cannot be held responsible for non-substantial errors or inaccuracies in the photographs or graphic representations of the Products appearing on the Site. If you have any questions about the Products, you can contact our Customer Service.

For more information regarding payment terms (currencies, accepted payment methods etc.), please refer to the article below “6. Prices - Accepted Payment Methods.

Once completed, your order is transmitted to THUILLIER PARIS for processing. The sales contract will be formed once we have received your order. We will proceed to ship your Product subject to the availability of the purchased Product (as provided above) and the effective payment of the Product. THUILLIER PARIS reserves the right not to accept an order from a customer with whom it is in dispute for a previous order, or if THUILLIER PARIS reasonably believes that this customer has violated these General Conditions or has engaged in fraudulent activity, or for any other legitimate reason.


5.2.c) Order summary

A summary of your order will then be sent to you by email. This summary will include the total amount of the order, information relating to the cost and delivery time,
the essential characteristics, quantity and price of the Products purchased.
We advise you to keep this summary on an electronic medium. You will then receive an e-mail confirming the dispatch of your order with your
electronic invoice attached. We make every effort to ensure that our communications are sent to you within
best deadlines.

We advise you to check your "Spam" folder if you have not received the shipping confirmation email.

In application of article L213-1 of the Consumer Code, when an order concerns an amount equal to or greater than 120 Euros, THUILLIER PARIS keeps the document which records the contract concluded between THUILLIER PARIS and a customer electronically for a period running from the conclusion of the contract until the date of delivery of the goods and for a period of ten years from this date (in accordance with decree 2005-137 of February 16, 2005). You then have access to this document at any time, upon request made to Customer Service after proof of your identity.

5.3. Telephone order procedure

You may order a Product by calling our Customer Service (see section "3. Ordering Procedures"). To place an order, you will need to provide the following information ("Order Details"):

  • Product Information: the name and/or reference number of the product requested, the quantity required and, where applicable, the colour, size, material, finish and any other identifying information we require; and
  • Personal data: your title, first name, last name, telephone number, email address, delivery address and, where applicable, billing address.

We will inform you whether the requested Product is available and, if so, the purchase price of the product, the estimated collection or delivery date and any delivery charges. Please ensure that the delivery information you provide is correct. Incorrect information may result in a delay or loss of your order. THUILLIER PARIS will not be responsible for replacement or refund if the information you have provided is incorrect.

If you choose to proceed with the order, you will receive an email or text message (depending on the chosen method of communication) containing a link to an external payment platform. You just need to click on the link to be redirected to the payment platform where you will find the details of the order and the purchase price ("Order Information"). Before making the payment, you must verify the accuracy of the Order Information.

Regarding the accepted payment method, you can refer to article 6 "Price - Accepted payment methods", it being specified that we are not able to accept PayPal and Apple Pay payments for telephone orders.

Once you have confirmed the order data, provided, and accepted these General Conditions of Sale and our Privacy Policy, you can proceed to the payment of the order by clicking on the "Pay" button. THUILLIER PARIS will not have access to any banking data.

Once payment is made, you will receive an order summary. We recommend that you keep this email. THUILLIER PARIS will then process your order.

The contract of sale will be formed once you have placed your order. We will dispatch your Product subject to the availability of the purchased Product (as provided for in clause 4) and actual payment for the Product. You will receive a dispatch confirmation email when your order is dispatched.

The Order Data collected by THUILLIER PARIS constitutes proof of all transactions between THUILLIER PARIS and its customers. In the event of a dispute between THUILLIER PARIS and one of its customers relating to a transaction carried out on the Site, the Order Data collected by THUILLIER PARIS will be considered as irrefutable proof of the content of the transaction.

5.4. Invoices

Your invoice will be sent by THUILLIER PARIS in a shipping confirmation email. We do our utmost to ensure that our communications reach you in a timely manner.

However, it is possible that some emails may be spam. Therefore, we advise you to check your spam folder if you have not received your shipping confirmation email.

You can also download your electronic invoices in the "Your orders" section of your personal account. A customer account is automatically created for each order. To access your electronic invoices, you must log in to your account. If you have never logged in before, you can click on the account confirmation email to create a password or you can create a password directly on the site by clicking on "forgotten password".

If you wish to receive a printed version of your invoice, you can make an express request to our Customer Service, within a maximum period of one (1) month from the dispatch of your order.

6. Prices – Accepted Payment Methods

6.1. Price

The prices of the Products are indicated in Euros, all taxes included. Except in cases of reimbursement made (i) in the context of exercising the right of withdrawal or for (ii) lack of conformity and hidden defects, THUILLIER PARIS will not reimburse the VAT applied to purchases made on the Site (even in the case where the buyer, after receipt, reships the Products to a third country).

The Products are invoiced on the basis of the prices displayed on the Site at the time you place your order, subject to availability.

All orders are payable in Euros and must be paid at the time of placing your order. In the event of unavailability of certain Products ordered (see Article 4 “Availability of Products”), only the price and transport costs relating to the available Products will be debited.

6.2. Accepted payment methods

6.2.a) Payment by credit card or bank card

The credit cards and bank cards accepted are: Visa®, MasterCard®, American Express®, Carte Bleue®. Payments by bank card are authenticated and secured thanks to the 3D Secure system.

When paying, the bank asks the Internet user for personal information in order to verify the identity of the cardholder and validate the transaction.

After validating your bank details (card number, expiration date and cryptogram), a new page will open on which you will have to enter the personal information requested by your bank. This information can be:

  • the answer to a personal question;
  • a password that you have chosen beforehand;
  • a code sent by SMS,
  • your date of birth

Once the 3D Secure code has been entered and validated by your bank, your order is finalized. You will then receive a confirmation email.

Authentication is specific to each bank. For any questions regarding your 3D Secure code, we invite you to contact your bank directly.

Your order can only be shipped after verification of your payment method and receipt of authorization to debit your card. Your account will be debited at the time your Order is shipped.

6.2.b) Payment by Paypal

We accept payments made by Paypal for purchases made directly on the Site only.

If you choose the Paypal payment option, you will be automatically redirected to the Paypal platform. If you do not have a PayPal account, you can create one at this time.

6.2.c) Payment by Apple Pay

We accept payments made by Apple Pay for purchases made directly on the Site only.

This payment method is available from Apple devices on which you have entered your information in the Apple Pay payment application.

7. Reservation of Title

The Products ordered remain the property of THUILLIER PARIS until full payment of the price by THUILLIER PARIS.

On the other hand, you assume the risks (in particular of loss, theft or deterioration) linked to the Products delivered from their delivery to the address indicated when ordering.

8. Delivery terms

8.1. Delivery and collection area

Products purchased on the Site and/or by telephone can only be delivered to mainland France including the island of Corsica (excluding Guadeloupe, Martinique, Guyana, Réunion, Mayotte, New Caledonia and the French Southern and Antarctic Lands), the Principality of Monaco, Germany (excluding the island of Heligoland and the territory of Busingen), Belgium, Luxembourg, the Netherlands (excluding the Netherlands Antilles and Aruba), Spain (excluding the Canary Islands, Ceuta and Melilla), Portugal (excluding the Azores and Madeira), Italy (excluding Livigno, Campione d'Italia and the national waters of Lake Lugano), Ireland, Austria (excluding the municipalities of Jungholz and Mittelberg), the Czech Republic, Finland (excluding the islands Aland), Denmark (excluding Greenland and the Faroe Islands), Sweden and Poland (hereinafter the “Delivery Area”).

The Products are shipped to the delivery address you provided during the ordering process.

We reserve the right to request a signature and valid identification upon delivery (e.g. passport or driving license).

8.2. Delivery costs

Deliveries (conditions applicable subject to the availability of the following shipping services at the time of purchase).

8.3. Delivery times and terms

When ordering, we will inform you of the delivery time which will be confirmed in the order shipping confirmation. The delivery time indicated below starts from the email shipping your order, this time may be extended in the event of exceptional circumstances.

Any order placed on a non-working day will result in the delivery time being postponed to the next working day.

THUILLIER PARIS reserves the right to split deliveries depending on the availability of the products ordered.

Orders including a personalized Product are subject to specific delivery times, these will be communicated at the time of ordering.

Any change to the delivery terms must be made via the application provided or the website of our carrier. Failing this, THUILLIER PARIS cannot be held responsible in the event of non-compliance with the delivery terms provided below.

THUILLIER PARIS will not be liable in the event of non-compliance with deadlines (late delivery, impossibility of delivery, return of Products to THUILLIER PARIS, etc.) resulting from the incorrect and/or incomplete nature of the information provided by you for the purpose of delivery and/or your absence at the time of delivery.

9. Delivery problems

Any defect or delay in delivery exceeding the delivery times must be reported to our Customer Service as soon as possible.

In the event of non-compliance with the delivery deadline, you may formally notify THUILLIER PARIS to make delivery within a reasonable additional period. In the event of non-delivery at the end of this additional period, you may cancel the order in writing.

However, in the event of non-compliance with the delivery deadline, and without additional delay, you may immediately cancel the order under the conditions of Article L. 216-6 of the Consumer Code, if you have indicated to us that compliance with the delivery deadline is an essential condition of your purchase.

THUILLIER PARIS will then be required to reimburse you for all amounts paid, at the latest within fourteen (14) days following the date of termination of the sales contract. If you nevertheless receive the Product after using this option, you must return it according to the return procedures provided for in Article 11 below.

You must check the conformity of the Products at the time of delivery and indicate, if possible on the delivery note, in the form of handwritten reservations accompanied by your signature, any anomalies noted (open package, damaged product, etc.).

You must then contact Customer Service (see Article 3). In the event of non-conformity of the Products purchased or if they do not satisfy you, you can return them or request an exchange or refund under the conditions set out in Articles 10 “Right of withdrawal” and 11 “Terms of return, exchange and refund”.

10. Right of withdrawal

10.1. Right and period of withdrawal

You have a legal right of withdrawal that you can exercise under the conditions provided for in Articles L221-18 and L221-20 of the Consumer Code, if you meet the conditions set out in these provisions, without having to provide reasons and without having to pay penalties.

The general return policy (for refund or exchange requests) of THUILLIER PARIS allows you to withdraw within thirty (30) days from the date of delivery of the Products, without having to provide reasons and without having to pay a penalty. After this period, you will no longer be able to exercise your right of withdrawal.

10.2. Terms of exercising the right of withdrawal

We offer you the possibility to complete and submit your withdrawal request online by logging into your customer account. You will then receive confirmation of your withdrawal by email without delay.

You can also send your withdrawal request by contacting our Customer Service or using the withdrawal form template available in the appendix to these General Conditions of Sale.

10.3. Restriction on the right of withdrawal

In accordance with Article L. 221-28 of the Consumer Code, your right of withdrawal cannot be exercised for personalized Products.

10.4. Consequence of the right of withdrawal

As part of the exercise of the right of withdrawal or in the event of non-conformity of the Product, you can return the Product(s) purchased by requesting an exchange or refund under the conditions described in article 11 below.

11. Return, exchange and refund terms

11.1. From the website www.thuillierparis.com

11.1.a) Free return procedure

The Products must be returned from a country in the Delivery Zone and according to the terms set out below. THUILLIER PARIS will not be liable for any losses, damages and/or delays related to returns made from a country located outside the Delivery Zone (see article 8.1) and/or not complying with the following terms.

Any additional costs (taxes and/or customs duties) and/or any formalities for customs clearance for a return from a country located outside the Delivery Zone will be your sole responsibility.

The Products must be returned in their original condition and packaging (the orange box and the shipping carton), accompanied by their purchase invoice or a copy in the event of a partial return.

Returning a Product for exchange or refund is free. To do so, you must return the Products to us through our selected carriers, within a maximum of thirty (30) days from your notification of withdrawal, using our prepaid return label system. Log in to your customer account and click on "Return or exchange of items" in the "Your orders" section.

To organize the return of your Product, please follow the instructions provided in the return procedure (see "Return or exchange of items" in the "Your orders" section) and/or by e-mail which will allow you to:

  • choose the Products to return as well as the reason for the return;
  • choose return mode

If returning for a refund and you have chosen paid shipping for your order, the refund will not include shipping costs.

You will then have a maximum period of thirty (30) days from the registration of the return to return your package to the address provided by our Customer Service.

11.1.b) Exchange

In case of exchange request, please specify in the dedicated field the Product(s) you wish to receive in exchange for your order.

If the amount of the Product(s) chosen as a replacement has a value greater than the amount of the Product(s) returned, you will have to pay the price difference by credit card using our secure payment service.

If the amount of the Product(s) chosen as a replacement has a value lower than the amount of the Product(s) returned, the price difference will be refunded to you by THUILLIER PARIS (it being recalled that for gifts, only the customer who purchased the gift can request a refund and have their bank account credited).

In case of exchange, the shipping costs of the first delivery will be refunded, but the shipping costs of the second shipment will be charged according to the chosen delivery method. Please note that the exchange will take place within seventy-two (72) business hours from receipt of the product(s).

11.1.c) Reimbursement

In the event of a refund request, the latter will take place immediately upon receipt of the Product(s). A confirmation email will be sent to you. The refund, including the delivery costs of the initial order, will then be made using the same payment method used when ordering and will be made in the same currency as that used when paying for the order.

Please note however that your bank may take up to ten (10) business days to issue a refund to your card, depending on processing times. This varies between card issuers, THUILLIER PARIS is unable to expedite this process which is beyond our control.

11.1.d) Gifts ordered from the Site

Third-party beneficiaries of gifts ordered from the Site may exclusively exchange the Products via the return procedure on the Site. Consequently, only the customer who purchased the gift may request a refund under the right of withdrawal (insofar as only the bank account of the person who ordered the product can be re-credited).

If applicable, only an exchange for a Product of an equivalent or higher value (the price difference must then be paid by the third party beneficiary of the gift) is possible. The third party beneficiary must contact our Customer Service who will record the exchange.

12. Legal guarantees

The Products sold by THUILLIER PARIS are subject to the legal guarantee conditions provided for by articles L217-4 to L217-14 of the Consumer Code as well as by articles 1641 to 1648 of the Civil Code, to the exclusion of all other guarantees:

These legal guarantees apply independently of the commercial guarantee referred to in article 12.2.

Legal guarantee of conformity (L217-4 to L217-14 of the Consumer Code):

THUILLIER PARIS will deliver to you a Product that complies with the contract and is free from defects in conformity upon delivery of said Product, in the sense that the Product will be suitable for the use usually expected of a similar good and that it will have the characteristics described at the time of sale. THUILLIER PARIS is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when this has been placed in its charge by the contract or has been carried out under its responsibility. This guarantee will only apply if you request it within two years of delivery of the good. Defects in conformity that appear within twenty-four (24) months of delivery are presumed to exist at the time of delivery, unless proven otherwise.

You can choose between repair and replacement of the Product unless one of these choices is impossible or involves a clearly disproportionate cost for THUILLIER PARIS, in which case THUILLIER PARIS may choose the other solution. In addition, in the event of a serious lack of conformity, you can have the price paid refunded and return the Product or keep the Product and have part of the price refunded. The repair, replacement or refund of the Product will be free of charge for you and do not prevent the possible allocation of damages if you are entitled to them.

Legal guarantee against hidden defects (art. 1641 to 1648 of the civil code):

THUILLIER PARIS will provide you with a Product free of hidden defects that would make it unfit for the use for which it is intended, or that reduce this use so much that you would not have purchased it, or would have paid a lower price for it, if you had known about them. This warranty will only apply if you make the request within two (2) years from the discovery of the defect and in any case within five (5) years from the date of purchase. In the event of a hidden defect, you will have the choice of returning the Product and having the price and costs incurred by the sale refunded or of keeping the Product and having part of the price refunded.

In any case, it will be up to you to prove that you meet the conditions of the guarantee.

In the event of a lack of conformity and hidden defects, you must return the Products to us in THUILLIER PARIS by contacting our Customer Service.

13. Limitation of liability

Under no circumstances can THUILLIER PARIS be held liable for any damage damage which would not result from a failure by THUILLIER PARIS to fulfill one of its obligations.

14. Applicable law - Disputes

These General Terms and Conditions of Sale are governed by and interpreted in accordance with French law. In the event of a dispute relating to the application and/or interpretation of these General Terms and Conditions of Sale, you may contact our Customer Service (see Article 3). You may also resort to a conventional mediation procedure or any other alternative dispute resolution procedure.

In accordance with Ordinance No. 2015-1033 of August 20, 2015 and Implementing Decree No. 2015-1382 of October 30, 2015, any dispute or litigation referred to as consumer dispute, subject to Article L612-2 of the Consumer Code, may be subject to amicable settlement by mediation with the CMAP – Centre de Médiation et d’Arbitrage de Paris. To submit a dispute to the mediator, the customer may (i) complete the form on the CMAP website: www.cmap.fr tab “you are: a consumer” (ii) send their request by regular or registered mail to CMAP Médiation Consommation, 39 avenue Franklin D. Roosevelt, 75008 PARIS, or (iii) send an email to consommation@cmap.fr. Regardless of the means used to contact the CMAP, your request must contain the following elements to be processed quickly: your postal, email and telephone contact details as well as the full name and address of THUILLIER PARIS, a brief statement of the facts, and proof of prior steps taken with THUILLIER PARIS.

In the event of a dispute relating to the execution of an order, if you are a natural person end consumer, you have the possibility of resorting free of charge to a conventional mediation procedure or to any other alternative dispute resolution procedure. You may, if you wish, use the online dispute resolution service offered by the European Commission in accordance with Article 14 of Regulation (EU) No 524/2013. This platform is accessible at the following address: https://webgate.ec.europa.eu/odr/. Recourse to mediation is an alternative mechanism which does not constitute a precondition for the exercise of legal action.

In accordance with Article L. 223-1 of the Consumer Code, you have the possibility to register free of charge on a Bloctel telephone canvassing opposition list (www.bloctel.gouv.fr) in order to no longer be telephone canvassed by a professional, except when it concerns solicitations occurring within the framework of the execution of a current contract and having a relation with the object of this contract.
